This Privacy Policy explains how Sunergise Limited (“Sunergise”, “we”, “us”, “our”) collects, uses, discloses, and protects personal information when you visit sunergise.nz or clayenergy.com.fj, interact with us as a customer or supplier, or otherwise deal with us in New Zealand, Fiji, or elsewhere in the Pacific.
This policy is written to meet our obligations under the Privacy Act 2020 (New Zealand) and the Unsolicited Electronic Messages Act 2007 (New Zealand). At the time of the writing, Fiji does not have a comprehensive data protection statute in force (a Privacy Bill has been proposed but not enacted), so for our Fiji operations and customers we apply the same standards as under the New Zealand Privacy Act as a matter of good practice, in addition to respecting the right to personal privacy guaranteed under section 24 of the Fijian Constitution.

Sunergise International Limited, including our related brands Clay Energy and PowerSmart, provides commercial solar solutions in New Zealand and Fiji.

2. What personal information we collect
We collect personal information in the following ways:
- Directly from you – when you fill in a contact or quote form, request a sales proposal, sign a contract, subscribe to any newsletters, or otherwise communicate with us by phone, email, digitally, or in person. This may include your name, job title, company name, email address, phone number, postal address, and details about your energy usage or site.
- Automatically through our website – including IP address, browser and device type, pages viewed, referring website, and approximate location, collected via cookies and similar technologies (see Section 5).
- From third parties – for example, from business contact data providers (see Section 5), publicly available company registers, LinkedIn, referral partners, or your employer if they engage us on your behalf.
We do not knowingly collect personal information from children, and our services are directed at businesses and adults.
3. Why we collect and use personal information
We use personal information to:
- respond to enquiries and provide quotes for renewable energy services;
- negotiate, perform, and manage contracts with customers, suppliers, and partners;
- operate, maintain, and improve our website(s);
- send marketing and updates about our services, where you have consented (you can unsubscribe at any time using the link in any marketing email, consistent with the Unsolicited Electronic Messages Act 2007);
- understand which companies are visiting our website, using visitor identification technology (see Section 5);
- meet our legal, accounting, health and safety, and regulatory obligations; and
- detect and prevent fraud, spam, or misuse of our website.
We only collect personal information that is reasonably necessary for these purposes, and we will tell you if we ask for information we are legally required to collect.
4. Disclosure of personal information
We do not sell your personal information. We may share personal information with:
- service providers who help us operate our business (for example, website hosting, email and CRM platforms, IT support, and analytics providers), under contractual obligations to protect your information;
- Our subsidiary companies and other related Sunergise group companies, for the purposes described in this policy;
- professional advisers, such as lawyers, accountants, and insurers;
- regulators, government agencies, or law enforcement where required by law; and
- a buyer or prospective buyer if we sell or restructure our business, subject to confidentiality protections.
Some of our digital service providers (see Section 5) may store or process data on servers located outside New Zealand and Fiji, including in the United States or other jurisdictions. Where personal information is sent overseas, we take reasonable steps to ensure it is protected to a standard comparable to New Zealand law, including by using providers with their own privacy and security commitments.

Our website uses cookies and similar tracking technologies to operate properly, understand how visitors use our site, and support marketing.

Managing cookies
When you first visit our site, a cookie consent banner allows you to accept or decline non-essential cookies and adjust your preferences at any time via the “Privacy Preferences” link in our website footer. You can also block or delete cookies through your browser settings, though this may affect site functionality.
Visitor identification technology
We use visitor identification technology to understand which companies visit our website. This technology matches your IP address to publicly available company information. We do not identify individual visitors or track personal browsing behaviour. This processing is based on your consent, which can be withdrawn at any time via cookie preferences.
Embedded content
Pages on our site may include embedded content (e.g. videos or social media posts). Embedded content behaves as if you visited the third-party site directly, and that third party may collect data about you, use cookies, and track your interaction with the content according to its own privacy policy.
6. Online advertising
We may use services to promote our services and measure advertising performance. These providers may use cookies, pixels, or similar technology to show you relevant ads on other websites and platforms based on your visit to our site. You can limit personalised advertising through your cookie preferences, browser settings, or directly through providersor the Network Advertising Initiative opt-out page (optout.networkadvertising.org).

We retain personalised information only for as long as necessary for the purposes set out in this policy, or as required by law (for example, tax and contract record-keeping obligations). 8. Security
We take reasonable technical and organisational steps to protect personal information from loss, misuse, unauthorised access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we review our practices regularly.
8. Your rights
Under the New Zealand Privacy Act 2020, and as a matter of good practice for our Fiji and Pacific customers, you have the right to:
- ask us to confirm whether we hold personal information about you and, if so, to access it;
- ask us to correct any personal information that is inaccurate, incomplete, or out of date;
- withdraw consent to marketing or to the use of cookies / visitor identification technology at any time; and
- ask us to delete personal information we hold about you, subject to our legal, contractual, or administrative obligations to retain it.
To exercise any of these rights, contact us using the details in Section 1. We will respond within a reasonable time and, in New Zealand, no later than 20 working days as required by the Privacy Act 2020.
If you are not satisfied with our response, in New Zealand you may contact the Office of the Privacy Commissioner (privacy.org.nz). Fiji does not currently have an established privacy regulator with a complaints function for the private sector; Fijian customers may instead raise concerns directly with us, or with the Fijian Human Rights and Anti-Discrimination Commission regarding constitutional privacy rights.
9. Where your data is sent
Form submissions may be checked through automated spam-detection or CRM services, which may be hosted outside New Zealand or Fiji.
10. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or the law (including if Fiji’s proposed Privacy Bill is enacted). The current version will always be available on this page, with the “last updated” date shown above.
